OVERVIEW

This website (shopdop.in, the "Site") is owned and operated by Hitgrove Enterprises (hereinafter referred to as "Shopdop.in", "we", "us", or "our"), a duly registered entity under the laws of India, with its principal place of business at Basement, C-40, Sector 58, Noida, Uttar Pradesh – 201301, and holding all necessary licenses, including but not limited to GST registration and Tobacco Vendor License as required under Uttar Pradesh regulations and the Cigarettes and Other Tobacco Products Act, 2003 ("COTPA").

Shopdop.in provides an online e-commerce platform for the sale of hookah products, accessories, and tobacco-related items (including shisha/flavored tobacco containing nicotine or tobacco), strictly in compliance with all applicable Indian laws, including but not limited to:

  • Cigarettes and Other Tobacco Products Act, 2003 ("COTPA")
  • Consumer Protection Act, 2019 ("CPA")
  • Consumer Protection (E-Commerce) Rules, 2020 ("E-Commerce Rules")
  • Information Technology Act, 2000 (as amended) ("IT Act")
  • Digital Personal Data Protection Act, 2023 ("DPDP Act")
  • Legal Metrology (Packaged Commodities) Rules, 2011 (as amended)
  • and all rules, notifications, and guidelines issued thereunder (collectively, "Applicable Laws").

By accessing, browsing, registering on, or using this Site, or purchasing any products or services (collectively, the "Service"), you (the "User" or "you") unconditionally agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, Shipping Policy, Refund Policy, Cancellation Policy, and any other policies or documents incorporated herein by reference (collectively, the "Agreement").

This Agreement constitutes a legally binding contract enforceable under Indian law. If you do not agree to any provision, you must immediately cease all use of the Site and Service and delete any account.

These Terms supersede any prior agreements or understandings. We reserve the absolute right, at our sole discretion, to update, modify, or replace these Terms at any time by posting the revised version on this page. Your continued use of the Site or Service after such posting constitutes your irrevocable acceptance of the changes. It is your sole responsibility to review this page periodically for updates. Any new features, tools, or services added to the Site shall automatically be subject to these Terms.

Our e-commerce platform is hosted by Shopify Inc., a third-party provider. While Shopify facilitates technical operations, Shopdop.in remains solely responsible for all content, transactions, compliance with Applicable Laws, and any liabilities arising from the Service. You acknowledge that your use of the Service is at your sole risk, and we disclaim any responsibility for third-party hosting issues.

SECTION 1 - USER ELIGIBILITY AND REPRESENTATIONS

To use the Site or Service, you represent and warrant that:

  1. You are at least 18 years of age (the minimum legal age under COTPA Section 6 and Indian Contract Act, 1872) and of sound mind, capable of forming a legally binding contract; minors (under 18) are strictly prohibited from using the Site or purchasing any products, even under supervision.
  2. You are not purchasing for, on behalf of, or facilitating access to any person under 18 years of age or within 100 meters of any educational institution (as defined under COTPA Section 6).
  3. You will not use the Service for any illegal, unauthorized, fraudulent, or prohibited purpose, including but not limited to violations of COTPA, anti-money laundering laws, export controls, or intellectual property rights.
  4. All information you provide (e.g., age, address, payment details) is true, accurate, complete, and current; you will promptly update it as needed. False declarations, especially regarding age or location for tobacco purchases, will result in immediate account termination, order cancellation, reporting to relevant authorities (e.g., District Tobacco Control Cell), and pursuit of all available legal remedies, including damages and criminal prosecution under Applicable Laws.
  5. You are not a business entity (e.g., retailer, wholesaler, or distributor) using the Site for commercial resale; the Service is for personal, non-commercial end-use only.
  6. You consent to electronic communications and records under the IT Act.

Any breach of these representations shall void the Agreement ab initio, and you agree to indemnify us fully as per Section 15. We reserve the right to verify your eligibility through ID checks (e.g., Aadhaar, PAN) at any stage, including delivery.

SECTION 2 - GENERAL CONDITIONS

We reserve the absolute right to refuse service, terminate accounts, cancel orders, or restrict access to anyone for any reason or no reason, without notice or liability, including suspected violations of these Terms or Applicable Laws.

Your content (excluding payment data) may be transmitted unencrypted over networks and adapted for technical compatibility. Payment information is processed via PCI-DSS compliant gateways and encrypted during transmission.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, or commercially use any portion of the Service without our express prior written consent. Unauthorized use constitutes a material breach.

Headings are for convenience only and do not affect interpretation or enforceability.

SECTION 3 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

All information on the Site (including product descriptions, pricing, images, and availability) is provided for general informational purposes only on an "as is" and "as available" basis. We do not warrant or represent its accuracy, completeness, timeliness, reliability, or non-infringement. You assume sole risk in relying on it and must verify independently, including consulting primary sources or professionals. Historical information is for reference only and may not be current. We reserve the right to modify or correct content at any time without notice or liability, but we undertake no obligation to update. No specified update date implies comprehensive modifications.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for products are subject to change without notice due to market conditions, taxes, or other factors. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice or liability to you or any third party.

SECTION 5 - PRODUCTS OR SERVICES

Products, including tobacco/shisha, are offered subject to availability, our Tobacco Policy (Section 12), and compliance with Applicable Laws. Quantities may be limited, and we reserve the right to restrict sales by person, household, region, or jurisdiction on a case-by-case basis.

Colors, images, and descriptions are approximate and for illustrative purposes only; actual products may vary due to monitor settings or manufacturing differences. We make no guarantees regarding display accuracy.

All products are sold "as is" and "as available" without any warranties or representations of quality, fitness for a particular purpose, merchantability, safety, legality, or non-infringement. We disclaim all responsibility for product defects, suitability, or performance. Any offer is void where prohibited by law.

We do not warrant that products will meet your expectations or that any errors in the Service will be corrected. For tobacco products, you acknowledge the inherent health risks and assume sole responsibility for use.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse, limit, or cancel any order at our sole discretion (e.g., for suspected fraud, resale, or high-risk transactions). Restrictions may apply to orders from the same account, payment method, or address. In case of changes or cancellations, we will attempt to notify you using provided contact details, but we assume no liability for failure to do so.

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all transactions. You must promptly update your details to enable completion of orders and communications. Inaccuracies may result in delays, cancellations, or additional charges, for which you are solely liable.

SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, services, or links (e.g., payment gateways, analytics) over which we have no control. Such access is provided "as is" and "as available" without any warranties, representations, or endorsements. Your use is at your sole risk and discretion; you must review and comply with third-party terms. We disclaim all liability arising from or related to such tools or services.

New features or third-party integrations added in the future shall also be subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS AND CONTENT

The Site may include content, products, or services from third parties, or links to external websites not affiliated with us. We are not responsible for examining, evaluating, or warranting the accuracy, completeness, or legality of such content or sites.

We disclaim all liability for any harm, damages, or losses related to purchases, use, or transactions on third-party sites. You must review third-party policies and practices independently before engaging. Complaints, claims, or questions regarding third-party offerings must be directed solely to the third party.

SECTION 9 - USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you submit comments, feedback, ideas, suggestions, or other materials (collectively, "Submissions")—whether requested or unsolicited—you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, edit, copy, publish, distribute, translate, and otherwise exploit such Submissions in any medium without restriction, compensation, or confidentiality obligations. We have no duty to respond, maintain confidentiality, or attribute authorship.

We may, but are not obligated to, monitor, edit, or remove Submissions that we deem, in our sole discretion, unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or violative of any party's rights (including intellectual property) or these Terms.

You represent and warrant that your Submissions:

  1. do not violate any third-party rights (e.g., copyright, trademark, privacy);
  2. are not unlawful, abusive, or malicious; and
  3. contain no viruses or harmful code.

You are solely responsible for the accuracy and legality of your Submissions, and we assume no liability therefor.

SECTION 10 - PERSONAL INFORMATION

Your submission and processing of personal information are governed exclusively by our Privacy Policy, which complies with the DPDP Act, IT Act, and all Applicable Laws. By using the Site, you consent to our collection, use, storage, and disclosure of your data as described therein.

SECTION 11 - ERRORS, INACCURACIES, AND OMISSIONS

The Site may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct such errors or cancel orders without prior notice (including after submission) and without liability. We undertake no obligation to update or clarify information, except as expressly required by Applicable Laws. No update or refresh date implies that all content has been modified.

SECTION 12 - TOBACCO POLICY (MANDATORY COMPLIANCE WITH COTPA AND APPLICABLE LAWS)

We are fully committed to strict compliance with COTPA 2003 (as amended), the National Tobacco Control Programme (NTCP), state tobacco regulations (including Uttar Pradesh mandates), and all Applicable Laws. Non-compliance by users will result in immediate termination, order cancellation, and reporting to authorities (e.g., District Tobacco Control Cell, Chief Medical Officer, or police), potentially leading to fines, seizures, or criminal proceedings under COTPA Sections 20–22.

  1. Age Verification
    All users must be at least 18 years old (COTPA Section 6). We implement mandatory DOB verification at registration and checkout, and may require government-issued ID (e.g., Aadhaar, PAN) during delivery. Purchases for or by minors are strictly prohibited and will trigger reporting obligations.
  2. Geographic and Sales Restrictions
    No sales or deliveries within 100 meters of educational institutions (COTPA Section 6). We verify addresses using GPS/mapping tools; non-compliant orders will be cancelled without refund. We do not sell to wholesalers, retailers, or for resale.
  3. Health Warnings and Packaging
    All tobacco products comply with COTPA Sections 7–11, including 85% pictorial and textual health warnings on both sides of packaging. Products also adhere to Legal Metrology Rules (e.g., MRP, net quantity, manufacture date, effective Feb 1, 2026) and packing machine duty regime under CBIC (effective Feb 1, 2026 for applicable items). We do not sell non-compliant or banned products (e.g., gutka, pan masala in restricted states).
  4. No Advertising or Promotion
    No direct, indirect, or surrogate advertising (COTPA Section 5). Product listings are factual and do not promote use.
  5. Responsible Consumption and Disclaimers
    Tobacco products contain nicotine (highly addictive), tar, carbon monoxide, and other harmful chemicals with no nutritional value. Use causes severe health risks, including cancer, heart disease, respiratory disorders, and addiction. Perceived benefits (e.g., stress relief, focus) are psychological, short-term, and vastly outweighed by risks. We strongly advise against use and provide resources for quitting (e.g., MoHFW Quit Tobacco Helpline: https://www.mohfw.gov.in/quit-tobacco). You assume sole risk for any health, legal, or other consequences of use; we disclaim all liability.
  6. Delivery and Verification
    Delivery personnel may refuse handover without valid ID or if location violates restrictions. False declarations are fraudulent and actionable.
  7. Returns and Refunds
    Due to perishability and health regulations, no returns/refunds for tobacco products except for defects/damage reported within 24 hours with verifiable proof (e.g., photos/video).
  8. Audits and User Interface
    We conduct regular audits to eliminate dark patterns or deceptive designs, per CCPA guidelines.
  9. Prohibited Activities
    In addition to Section 13, no facilitation of minor access, illegal resale, or violations of tobacco excise/duty laws.

SECTION 13 - PROHIBITED USES

You are strictly prohibited from using the Site or Service:

  1. for any unlawful, fraudulent, or unauthorized purpose;
  2. to solicit or facilitate illegal acts;
  3. to violate any international, federal, state, or local laws, including COTPA, GST, anti-money laundering, or export controls;
  4. to infringe intellectual property or privacy rights;
  5. to harass, defame, discriminate, or promote enmity/hate;
  6. to submit false/misleading information (e.g., age/location for tobacco);
  7. to upload viruses, malware, or disruptive code;
  8. to spam, phish, scrape, or data mine;
  9. for obscene, immoral, or harmful purposes;
  10. to interfere with security features; or
  11. for commercial resale, B2B transactions, or any activity threatening India's sovereignty, integrity, or public order.

Breaches will result in immediate termination, without notice or liability, and may lead to legal action or reporting to authorities.

SECTION 14 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

THE SITE, SERVICE, AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AVAILABILITY, OR FREEDOM FROM VIRUSES/ERRORS. WE DISCLAIM ALL LIABILITY FOR THIRD-PARTY CONTENT, PRODUCTS, OR SERVICES.

IN NO EVENT SHALL SHOPDOP.IN, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS (COLLECTIVELY, "SHOPDOP PARTIES") BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES) ARISING FROM OR RELATED TO THE SITE, SERVICE, PRODUCTS, OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY, IF ANY, SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

THIS LIMITATION APPLIES TO ALL CLAIMS, INCLUDING HEALTH RISKS FROM TOBACCO USE, DELIVERY DELAYS, THIRD-PARTY ACTIONS, OR FORCE MAJEURE EVENTS. SOME JURISDICTIONS MAY NOT ALLOW EXCLUSIONS, SO THEY APPLY TO THE MAXIMUM EXTENT PERMITTED. YOU MUST COMMENCE ANY ACTION WITHIN ONE (1) YEAR OF THE CLAIM ARISING, OR IT IS FOREVER BARRED. YOU HEREBY RELEASE SHOPDOP PARTIES FROM ALL CLAIMS RELATED TO THIRD-PARTY TRANSACTIONS OR CONTENT.

SECTION 15 - INDEMNIFICATION AND RELEASE

You agree to indemnify, defend, and hold harmless Shopdop Parties from and against all claims, demands, losses, damages, liabilities, costs, expenses (including reasonable attorneys' fees and court costs), suits, or proceedings arising from or related to:

  1. your breach of these Terms or Applicable Laws;
  2. your use or misuse of the Site, Service, or products;
  3. violations of third-party rights (e.g., intellectual property, privacy);
  4. false declarations (e.g., age/location for tobacco);
  5. fraudulent activities; or
  6. any health, legal, or other consequences from product use.

This obligation survives termination of the Agreement. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully. You may not settle any claim without our prior written consent. You hereby irrevocably release Shopdop Parties from all known and unknown claims related to the foregoing.

SECTION 16 - SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable by a competent court or authority, such provision shall be severed, and the remainder shall remain fully enforceable to the maximum extent permitted by law.

SECTION 17 - TERMINATION

These Terms are effective until terminated by you or us. You may terminate by ceasing use and notifying us. We may terminate immediately, without notice, for any breach or suspected breach.

All obligations and liabilities accrued prior to termination (e.g., payments, indemnities, disclaimers) shall survive indefinitely. Upon termination, your right to use the Site and Service ceases, and we may delete your account/data without liability.

SECTION 18 - GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any disputes arising hereunder shall be governed exclusively by the laws of India, without regard to conflict of laws principles.

Any dispute, controversy, or claim shall first be resolved amicably through good-faith negotiations. If unresolved within 30 days, it shall be referred to binding arbitration under the Indian Arbitration and Conciliation Act, 1996 (as amended), conducted by a single arbitrator appointed by us, in English, at Noida, Uttar Pradesh. The arbitral award shall be final and binding.

Subject to arbitration, exclusive jurisdiction lies with the competent courts at Noida, Uttar Pradesh. You waive any objection to venue or jurisdiction. No class actions or representative proceedings are permitted; disputes must be individual.

SECTION 19 - GRIEVANCE REDRESSAL MECHANISM

In compliance with Rule 4 of the E-Commerce Rules, we have appointed a Grievance Officer to address any complaints or concerns regarding these Terms, the Service, products, or violations of Applicable Laws (including COTPA or consumer rights).

Complaints must be submitted in writing with supporting evidence. We will acknowledge receipt within 48 hours and resolve within 30 days (or as per Applicable Laws). For order-specific issues, use in-Site support first. Unresolved grievances may be escalated to consumer forums or authorities, but you agree to exhaust this mechanism first.

SECTION 20 - CHANGES TO TERMS

You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part by posting revisions. Your continued use constitutes acceptance. It is your responsibility to check periodically.

SECTION 21 - MISCELLANEOUS

  • No Waiver: Failure to enforce any right does not constitute a waiver.
  • Force Majeure: No liability for delays due to events beyond our control (e.g., acts of God, pandemics, government actions).
  • Assignment: We may assign these Terms without notice; you may not.
  • Entire Agreement: These Terms constitute the entire agreement, superseding prior understandings.
  • Electronic Execution: Acceptance via Site use is valid under IT Act.
